These Terms of Service ("Terms") govern your access to and use of the Kolde store, website and related services (the "Services"). The Services are operated by Kolde and powered by Shopify. By accessing or using the Services, placing an order, or creating an account, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms, you must not access or use the Services.

Eligibility and Accounts

Rentals and Use of Devices

Where the Services include the rental of recovery devices, you agree to use the devices only in accordance with the instructions provided, for the agreed rental period, and to return them in the condition in which they were received, subject to reasonable wear. You are responsible for loss of or damage to rented devices while in your possession.

The devices and any related information are intended to support recovery and are not a substitute for professional medical advice, diagnosis, or treatment. Always follow the guidance of your physician or qualified healthcare provider.

Shipping, Delivery and Returns

Delivery times are estimates and are not guaranteed. Risk of loss and title for purchased products pass to you upon delivery. Any returns, exchanges or refunds are governed by our then-current return policy, which forms part of these Terms.

Acceptable Use

You agree not to use the Services for any unlawful or prohibited purpose. In particular, you agree not to:

• Violate any law or regulation or infringe the rights of any third party;
• Interfere with or disrupt the integrity or performance of the Services or any related systems or networks;

To the maximum extent permitted by law, Kolde and its affiliates, officers, employees and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of or inability to use the Services.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to these Terms or the Services will not exceed the amount you paid to us for the products or services giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless Kolde and its affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the competent courts of Dubai, UAE.
